Terms and Conditions of Service

1. Introduction & Contracting Parties

These Terms and Conditions constitute a binding agreement between:

  • The Provider: Physical & Nutrition Ltd (Company Number: 14207771), registered at Falcon Business Centre, Victoria Street, Chadderton, Oldham, England, OL9 0HB (hereinafter referred to as "We", "Us", or "P&N").
  • The Client: The individual accessing the premises or purchasing services (hereinafter referred to as "You" or "The Member").

By entering our premises, paying fees, or booking a service, you explicitly consent to these terms. We reserve the right to amend these terms at any time. While we will use reasonable endeavours to notify you of updates, continued use of our services constitutes acceptance of any changes.

Important: If you do not agree to these terms, you must not enter the premises or use our services.

2. Personal Training (In-Person)

We offer bespoke 1-1 coaching designed to meet your specific goals.

Exclusivity

Unless you have booked a "Partner Session" (training with a friend), the gym facility is exclusive to you during your booked slot.

Duration

All sessions are 30 minutes unless explicitly agreed otherwise.

Punctuality

You must arrive on time. If you arrive more than 10 minutes late, the session will be cancelled. This will be treated as a "Late Cancellation" and charged accordingly.

Payments & Deposits

  • A 10% deposit is required to secure any booking.
  • Remaining fees must be cleared before the session begins.
  • Failure to pay allows us to suspend your booking privileges.

Junior Clients

Clients aged 16 or under must be supervised by an authorized adult (18+) throughout the session.

3. Membership Structures

A. Rolling Monthly Contract

  • Commitment: None. This is a flexible pay-monthly agreement.
  • Cancellation Notice: You must provide 30 days' written notice prior to your next payment date to cancel.
  • Termination: We will confirm the final date of your gym access upon receipt of your notice.

B. Yearly Membership (Unlimited PT)

  • Scope: Includes an unlimited number of Personal Training sessions (capped at one session per day).
  • Payment Options: Upfront Payment in full, or 12 x Monthly Instalments via Direct Debit.
  • Lock-In Period: By selecting Direct Debit, you are committed to the full 12-month term. You cannot cancel mid-term without penalty.
  • Payment Schedule: Direct debits must be cleared in advance of the calendar month (e.g., payment on 1st July covers July access).
  • Forfeiture: If you arrive 10+ minutes late, you forfeit that specific session for the day.

4. Online Coaching

Our digital coaching requires client accountability and adherence to the program for results.

  • Duration: Plans run for a minimum of 16 weeks and a maximum of 52 weeks.
  • Payment: The first 4 weeks must be paid in full before the program or nutrition plan is released.
  • Client Requirements: Recommended training frequency: 2+ sessions per week. You must attend at least 2 check-in calls per month to maintain the coaching relationship.

5. Class & Community Guidelines

Classes are designed to foster community and shared achievement.

  • Updates: Class schedules and updates are communicated via the Community WhatsApp Group.
  • Payment: Must be made in advance (Pay-Per-Class or Monthly Pass).
  • Arrival Protocol: Please arrive 5 minutes early. Entry may be refused once the class has started to prevent disruption and injury risks.

6. Cancellation & Rescheduling Policy

We understand emergencies happen, but late cancellations impact our business and other members.

  • Notice Period: You must provide at least 48 hours’ notice to cancel or reschedule a session.
  • Cancellation Fee: Failure to provide 48 hours' notice will incur a £10.00 Cancellation Fee.
  • Exception: Genuine emergencies (at our discretion).
  • Payment Block: The cancellation fee must be settled before you can attend your next session.
  • Provider Cancellation: If P&N cancels your session, you will be notified immediately, and the session will be re-booked free of charge.

7. Fees & Payments

  • Right to Amend: We reserve the right to change our pricing structure at any time.
  • Exception: Active Yearly Memberships and Fixed-Term Packages are price-locked for the duration of the agreed term.
  • Promotions: Promotional packages are subject to availability and may vary seasonally. We are not obliged to offer retrospective discounts.
  • Refunds: All fees paid are non-refundable. Exception: Serious health issues (Medical evidence may be required). Other resolutions are at our total discretion.

8. Health, Safety & Liability

  • ParQ Form: You must disclose any health issues, injuries, or medical conditions on your Physical Activity Readiness Questionnaire (ParQ) before training.
  • Training Alone: If you use the facility without a trainer present (e.g., Gym Access Membership), you do so at your own risk. You are responsible for your own health and safety.
  • Assistance: If you are unsure how to use equipment, you must seek assistance from a staff member immediately.

9. Home Visit Services

We bring the gym to you within a 10-mile radius of our facility.

  • Minimum Term: 8 Weeks (Recommended 1 session/week).
  • Safeguarding Policy: For the safety of both client and trainer, one other person must be present in the home during the session.
  • Consent: You may be required to sign a specific consent form upon our arrival.

10. Taster Sessions

We may offer a one-time complimentary 30-minute session for new clients. This is limited to one per person and subject to availability.
